1. Provider & service

Provider and contact: see the Imprint. Magictive is a browser-based tool that synchronises GPS / vehicle / biometric telemetry with video and renders overlays. Import, synchronisation and rendering run locally in your browser; your footage is not uploaded to the Provider. These terms apply to consumers (KSchG) and entrepreneurs.

2. Prices

Free: all features, watermarked, baked into your video. Pro removes the watermark and unlocks transparent overlay export. Pro is a recurring subscription (monthly or yearly); the current price and the applicable VAT are shown at checkout before you order. Prices are total prices in EUR including VAT (charged at the consumer's country rate under the EU One-Stop-Shop scheme; the displayed total does not change by country). Recurring plans renew automatically for the same period until cancelled.

3. Contract conclusion (§9 ECG)

The paid contract is concluded via Stripe-hosted checkout: you select a plan, the essential characteristics and the total price are shown again immediately before the order, and you confirm with a button clearly labelled as payment-obligating. Input errors can be corrected before submitting in the checkout. The contract language is English. We send a confirmation of the contract on a durable medium (email); the contract text is not separately stored for later retrieval beyond that email.

4. Performance

Pro access is provided immediately after the contract is concluded and payment is confirmed.

5. Right of withdrawal

Consumers have a 14-day right of withdrawal and a model withdrawal form; the conditions under which it lapses early for this digital service, and the form, are on the Withdrawal & Cancellation page, which forms part of these terms.

6. Statutory warranty

The statutory warranty provisions (Gewährleistung) apply; they are not affected by any voluntary guarantee. No separate guarantee is given.

7. Liability

Mandatory liability (in particular for personal injury, intent and gross negligence, and under the KSchG and Product Liability Act) is unaffected. Beyond that the Service is provided "as is"; we do not warrant uninterrupted or error-free operation.

8. Governing law

Austrian law applies, excluding its conflict-of-laws rules and the UN CISG; mandatory consumer-protection provisions of the consumer's country of habitual residence and their statutory venue remain unaffected. For entrepreneurs, the exclusive place of jurisdiction is Salzburg, Austria.
